We’re thrilled to share some exciting news from the Southern District of Florida (federal) courthouse. In a recent federal court hearing, Firm Client was facing 262-327 months, or approximately 27 years, as the potential guideline sentence in a federal prison. The offenses carried a maximum of 30 years, to life. Ron Herman fought tirelessly to ensure that his Client’s sentence reflected the unique circumstances of their situation. The United States Department of Justice initially strongly supported a 2 point increase in the Guidelines range. Undeterred, Ron continued to vigorously advocate for his Client, presenting persuasive factual and legal arguments, which were included in the filed objections to the Guidelines range.
In a rare occurrence, the U.S. Attorney’s Office agreed to withdraw its adverse position, resulting in a significant reduction to the amount of prison time the Client was facing. Both parties ultimately submitted a joint recommendation to the Court. U.S. District Court Judge Rudolfo Ruiz accepted the joint recommendation and our client received a much lower sentence.
